Registered Address: Unit No 353, Plot No H-9, 3rd Floor, Distt Centre, Netaji Subhash Place, Vardhman Corporate Plaza, Pitampura, Delhi – 110034.

These Terms and Conditions govern the relationship between Amethist Media (hereinafter referred to as “the Studio”) and the Client (individual or entity booking the services).

1. Booking and Payment

1.1. Reservation: A booking is only confirmed upon receipt of a non-refundable retainer/booking fee (typically 50% of the total quote) and a signed copy of these terms.
1.2. Payment Schedule: The remaining balance must be cleared as follows:

  • Commercial/Product Shoots: On the day of the shoot.

  • Weddings/Events: At least 7 days prior to the event date.
    1.3. Overtime: Any additional hours worked beyond the agreed-upon contract will be billed at an hourly rate of [Insert Amount].

2. Cancellation and Rescheduling

2.1. Cancellation by Client: If the Client cancels the shoot, the booking fee is forfeited. If cancellation occurs within 48 hours of the shoot, the Client is liable for 100% of the total fee.
2.2. Rescheduling: Rescheduling is permitted once, provided notice is given at least 7 days in advance, subject to studio availability. A rescheduling fee may apply.
2.3. Force Majeure: In the unlikely event that the Studio cannot perform due to fire, casualty, strike, or other cause beyond the control of the parties, the Studio shall return the retainer but shall have no further liability.

3. Copyright and Usage Rights

3.1. Ownership: Irfan Media Pvt Ltd retains the Copyright to all images and videos produced.
3.2. Client Usage (B2C/Weddings): The Client is granted a non-exclusive license for personal use only (social media, prints). Commercial resale is prohibited.
3.3. Commercial Usage (B2B/Product): Commercial clients are granted usage rights for advertising and marketing as specified in the invoice.
3.4. Self-Promotion: The Studio reserves the right to use any images/videos for promotional purposes (website, social media, portfolio) unless a “Non-Disclosure Agreement” (NDA) or “Privacy Fee” is agreed upon in writing.

4. Image Delivery and Storage

4.1. Turnaround Time:

  • Product/Corporate: 5–7 working days.

  • Weddings/Films: 4–8 weeks depending on the season.
    4.2. Editing: The Studio will perform standard color correction and retouching. Extensive “body manipulation” or complex background removal may incur extra charges.
    4.3. Raw Files: Raw/unprocessed files are not provided to the Client as they represent an unfinished product.
    4.4. Storage: The Studio will archive the final images for 6 months post-delivery. Clients are responsible for downloading and backing up their files.

5. Drone Operations

5.1. Weather Dependency: Drone shoots are strictly subject to weather conditions (no rain or high winds).
5.2. Legal Compliance: The Studio will not fly in “No-Fly Zones” or near restricted government areas. The pilot has the final authority on flight safety.

6. Client Responsibilities

6.1. Punctuality: Shoot time begins at the scheduled hour. Delays caused by the Client (makeup, wardrobe, etc.) will be deducted from the shoot time.
6.2. Cooperation: The Studio is not responsible for compromised coverage due to uncooperative subjects or interference from guests/third-party vendors.

7. Amethist Academy & Workshops

7.1. Fees: Workshop fees are non-refundable but transferable to another person for the same date.
7.2. Liability: Participants are responsible for their own equipment during workshops. The Studio is not liable for damage to personal gear.

8. Studio Rental (NSP Location)

8.1. Damage: Any damage to studio property (lights, backdrops, furniture) caused by the Client or their guests will be billed at the actual replacement/repair cost.
8.2. Conduct: No illegal activities, hazardous materials, or smoking are permitted inside the Vardhman Corporate Plaza premises.

9. Limitation of Liability

9.1. In the unlikely event of technical failure (equipment malfunction, corrupted data), the Studio’s liability is limited to a refund of the fees paid for that specific portion of the service.

10. Jurisdiction

10.1. These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Delhi.

Consultant Strategy for the Website:

  1. Digital Signature: Use a plugin like WPForms or DocuSign so clients can “Check to Agree” when they pay their deposit online.

  2. Short Version on Invoice: Put a “Summary of Terms” on the footer of your PDF invoices, including the payment and copyright clauses.

  3. The “Privacy” Option: Since you do high-end weddings, some clients may not want their photos on Instagram. You can add a clause: “Private Gallery: A 15% surcharge applies if the client wishes to restrict the studio from using images for self-promotion.” This is a great way to monetize privacy.
